Terms of Sale (CGV)
Effective date: July 29, 2026
These Terms of Sale (CGV) apply to all paid transactions concluded on the Platform https://designeasehub.fr between DesignEaseHub (the "Publisher") and the Client (individual or professional). The French language version is the legally binding text.
1. Purpose and Products Sold
The Publisher offers the following categories of digital products and services: - User Subscription Plans: Paid plans ("Premium", "DesignEase Business") providing extended features (unlimited PDF exports, AI generations and visuals) - Digital Products (Add-ons): "Professional Blueprint Vault", "Rent-Ready Design Library" - AI Credits: Photo/visual recharge packs ("Mini", "Standard", "Max") - Professional Services for Teams: Subscription plans ("START", "PRO", "COMPANY") with matching quotas (response packs) and visibility options ("Pro Visibility", "Market Dominator") 1.2. Nature of the Platform and limitation of liability regarding the execution of works: DesignEaseHub acts exclusively as the publisher of an AI-assisted design technology platform and, with respect to Teams, as a matchmaking operator between Users and the Teams listed on the Platform. DesignEaseHub is neither an architect, nor a design office, nor a construction company, and does not intervene at any stage in the physical execution of works. Consequently, DesignEaseHub cannot be held liable for the execution, non-execution, delay, or poor execution of works carried out by the Teams, nor for their compliance with construction or urban-planning standards. Any contractual relationship concerning the execution of works is concluded exclusively between the User and the relevant Team.
2. Orders and Automatic Renewal
Every order implies express acceptance of these CGV (opt-in) and becomes final after email confirmation and payment collection. Subscriptions automatically renew for an identical period. Cancellation is available from the Personal Space at least 48 hours before the renewal date.
3. Pricing and Taxes
Prices are in Euros. Consumer clients see TTC (VAT included) prices; professionals see HT (ex-VAT) prices. Unused team response packs (tied to the START, PRO, COMPANY plans) are non-refundable and non-transferable to the next billing period. Maximum financial liability of DesignEaseHub is capped at the total amount paid by the Client in the preceding 3 months.
4. Digital Product Delivery
Digital products are delivered instantly after payment confirmation. Products are available in the user account for online use or download (PDF, DWG, images). No physical media is shipped. 4.3. Marking of AI-generated content: In accordance with the transparency obligations applicable to generative AI systems (notably Article 50 of Regulation (EU) 2024/1689, the "AI Act"), any visual, plan, or render produced by the platform's AI generation features is identified with the marking "Généré par IA" ("AI-generated"), directly on the delivered file or in the viewing interface. This marking recalls that the content results from algorithmic processing, may contain errors or approximations, and has no contractual, technical, or regulatory value: it cannot replace the plans or advice of a qualified professional (architect, design office, certified craftsman) before any implementation.
5. Right of Withdrawal
Under Article L.221-28 13 of the French Consumer Code, the right of withdrawal (14 days) does NOT apply to digital content delivered immediately after purchase. By confirming the order, the client consents to immediate delivery and expressly waives the right of withdrawal. For professional clients (B2B), no right of withdrawal applies under French commercial law; all sales of plans (START, PRO, COMPANY) or visibility options are firm and final.
6. Payment Security
Payments are processed exclusively by credit card (Visa, Mastercard, Amex) via Stripe. DesignEaseHub does NOT store any credit card data. All transactions are encrypted via SSL/TLS. DesignEaseHub may suspend orders upon payment authorization refusal or suspected fraud.
7. Invoicing
An electronic invoice is automatically issued for each transaction, sent by email, and available for PDF download in the Personal Space.
8. Chargebacks
The Client agrees not to initiate abusive chargebacks for confirmed transactions. In case of abusive chargebacks, DesignEaseHub may: immediately suspend the account; charge administrative fees of EUR 150.00 per disputed transaction; refer the matter to its collection agency.
9. Force Majeure
Neither party shall be liable for non-performance due to force majeure (Art. 1218, French Civil Code), including large-scale cyberattacks, prolonged power/telecom outages, hosting server failures (Contabo), AI API failures, or Stripe payment system disruptions.
10. Subscription Termination
Clients may cancel subscriptions at any time from their Personal Space. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided. DesignEaseHub may terminate subscriptions for serious violations (non-payment, illegal resale, abusive chargebacks) without notice.
11. Applicable Law and Jurisdiction
These CGV are governed by French law. 11.2. Consumer mediation: Any consumer Client may resort free of charge to a consumer mediator (Articles L.616-1 and R.616-1 of the Consumer Code) after a prior attempt to resolve the dispute with customer service (contact@designeasehub.fr). The designated mediator is CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), www.cm2c.net, 49 rue de Ponthieu, 75008 Paris. The European online dispute resolution (ODR) platform is also available: https://ec.europa.eu/consumers/odr. This mediation does not apply to professional Clients. 11.3. Disputes fall under the exclusive jurisdiction of the Lyon Commercial Court, even in the event of multiple defendants or third-party proceedings.
